<h1>Board-ul FMI aproba Acordul Stand-by cu Romania in valoare de 12.9 mld. EUR</h1>
<p style="text-align:justify;"> The Executive Board of the International Monetary Fund (IMF) today approved a 24-month SDR 11.4 billion (about €12.9 billion or US$17.1 billion) Stand-By Arrangement for Romania to support an economic program designed by the Romanian authorities and intended to cushion the effects of the sharp drop in capital inflows while addressing the country&#8217;s external and fiscal imbalances and strengthening the financial sector. The approval makes SDR 4.37 billion (about €4.9 billion or US$6.6 billion) immediately available and the remainder will be available in installments subject to quarterly reviews. The Stand-By Arrangement entails exceptional access to IMF resources, amounting to 1,111 percent of Romania&#8217;s quota.</p>
<p style="text-align:justify;">The Stand-By Arrangement will be combined with other multilateral financial support to fill the country&#8217;s 2009-2010 financing gap. The total international financial support package will amount to €19.9 billion (about US$26.4 billion), with the European Union providing €5 billion (or about US6.6 billion), the World Bank €1 billion (or about US$1.3 billion), and the European Bank for Reconstruction and Development (EBRD), the European Investment Bank (EIB), and the International Finance Corporation (IFC) a combined €1 billion (or about US$1.3 billion).</p>
<p style="text-align:justify;">Following the Executive Board discussion on Romania, Mr. John Lipsky, First Deputy Managing Director and Acting Chairman, said:</p>
<p style="text-align:justify;">&#8220;The Romanian authorities are to be commended for seeking early international support to assist them with an orderly correction of the large external imbalances and vulnerabilities built up during recent boom years, and leaving the country highly exposed to global financial turmoil and exchange rate volatility. Excessive public spending in recent years also produced sizeable fiscal deficits which, in the current tight financing environment, are destabilizing. With the global downturn increasingly spilling over to Romania, a rebalancing of the economy is unavoidable.</p>
<p style="text-align:justify;">&#8220;The Romanian authorities have launched a comprehensive program to respond to the current challenges. The program aims at reversing the deteriorating fiscal path with significant expenditure cuts and additional revenues. Planned fiscal reforms are designed to contain future expenditures pressures, improve the budgeting process, and enhance the efficiency of tax collections and government operations over the medium-term. An action plan is being implemented to maintain confidence in the banking system, including by preemptive bank recapitalization, agreements to maintain foreign banks&#8217; exposure in the country, and efforts to strengthen bank supervision and resolution. This program, combined with significant external financial support, should ease short-term funding pressures and enhance medium-term economic prospects.</p>
<p style="text-align:justify;">&#8220;The joint financial assistance being provided by the IMF, the European Union, and the World Bank will help cushion the economic downturn and will provide reassurance to markets that Romania&#8217;s external obligations will be met. It sends a strong signal of the international community&#8217;s confidence that, with the consistent implementation of the program, Romania will weather the current difficulties and emerge with a better-balanced and more flexible economy,&#8221; Mr. Lipsky said.</p>

<p style="text-align:justify;"><strong>ANNEX</strong></p>
<p style="text-align:justify;"><strong>Recent Economic Developments</strong></p>
<p style="text-align:justify;">Romania experienced an economic boom over the past five years that led to overheating and unsustainable imbalances. GDP growth averaged over 6½ percent per year from 2003-08, as foreign direct investment and capital inflows, in part through subsidiaries of foreign banks in Romania helped finance high consumption and investment growth. The rapid increase in borrowing that fueled the boom left Romania highly exposed to global financial difficulties and to exchange rate volatility. Loose fiscal and incomes policies also contributed to the overheating of the economy and to its current vulnerabilities, with excessive spending, especially on wages and pensions, as the main culprit.</p>
<p style="text-align:justify;">Economic activity turned down sharply in late 2008 and has fallen further in 2009. Growth is projected at about 4 percent in 2009 on account of a sharp contraction in domestic demand, which in turn will set off a correction in the current account deficit from 12½ percent of GDP in 2008 to 7½ percent in 2009. Foreign direct investment and capital inflows will drop sharply. Increased financial stress, tightening credit standards and limited access to external funding will inhibit lending to the private sector. Once confidence is restored, domestic demand is expected to slowly rebound, but growth will remain near zero in 2010, before recovering to 5 percent in 2011. Inflation is expected to fall in 2009 to within the official target (3.5 percent, plus or minutes 1 percent) and remain there in 2010.</p>
<p style="text-align:justify;"><strong>Program Summary</strong></p>
<p style="text-align:justify;">The IMF-supported program combines strong policy measures with sizable financial support. Key to restoring confidence is a reversal of the sharp increase in public spending, which caused a large deficit to accumulate even during a period of strong economic growth. Short-term budget cuts will be combined with fiscal policy reforms to place the public finances on a more sustainable path. The effects of the fiscal adjustment and budget reforms will be cushioned by boosting social safety net spending and safeguarding capital spending. Banking sector measures will also be implemented to ensure that banks remain sufficiently strong to weather the economic downturn.</p>
<p style="text-align:justify;">Specific program objectives include:</p>
<ul style="text-align:justify;">
<li>Reduce the fiscal imbalance to bring the deficit back under 3 percent of GDP by 2011.</li>
<li>Maintain adequate capitalization of banks and liquidity in domestic financial markets.</li>
<li>Bring inflation within the target range of the National Bank of Romania (NBR) by end-2009 and maintain it there.</li>
<li>Secure adequate external financing and improve confidence.</li>
</ul>
<p style="text-align:justify;">Romania joined the IMF on December 15, 1972, and its quota is SDR 1.03 billion (about €1.16 billion or US$1.54 billion). Its latest arrangement with the IMF was a Stand-By Arrangement that expired on July 6, 2006.</p>

			<content:encoded><![CDATA[<p style="text-align:justify;"><span style="text-decoration:underline;">VERY IMPORTANT UPDATE:</span> Noaptea este, intr-adevar, un sfetnic foarte bun. Astazi, 11 aprilie 2009, dupa un somn bun, un ness si mai bun (facut de mine) am inteles de ce Parchetului General i-au trebuit 60 de zile ca sa gaseasca o ¨solutie¨. Pai daca incepeau procedural cercetarea penala, Presedintele Romaniei, dl. Traian Basescu trebuia sa-l suspende pe ministrul Pogea, asa cum a facut si cu ministrul liberal Theodor Atanasiu si ramanea tara fara catastrofa. Daca cercetarea se extindea si asupra ministrului Videanu, cine naiba mai ¨gestiona¨ banii de la FMI si BM care treceau de BNR si ajungeau in ceea ce s-ar putea numi economiile &#8230; Simteam eu ca ceva se ascunde in spatele acestei facaturi. O mai reluam o data, cu asistenta de specialitate. Oare, ce face PNL-ul? &#8230;</p>
<p style="text-align:justify;">Astazi, am primit raspunsul la sesizarea pe care i-am transmis-o, la data de 16 februarie 2009,(<a href="http://gserban.wordpress.com/2009/02/16/doamnei-procuror-general-laura-codruta-kovesi-gheorghe-pogea/">http://gserban.wordpress.com/2009/02/16/doamnei-procuror-general-laura-codruta-kovesi-gheorghe-pogea/</a>) prin e-mail, doamnei Procuror General Laura Codruţa Kovesi cu privire la posibila savarsire de catre dl. Gheorghe Pogea a infractiunii de fals in declaratii. Imi luasem gandul ca voi primi vreun raspuns. Ma gandeam ca, cine stie, prin e-mail s-o fi pierdut si intentionam sa fac o scrisoare prin posta. Dar, iata, dupa aproape 60 de zile de analiza am primit raspunsul asteptat. Deci functioneaza si, mai mult, fara discriminari &#8220;pozitive&#8221;! Ce daca-i ministru? Ce daca-i PD-ist? Ce daca-i din familia de afaceri a lui Videanu si, deci, a lui Basescu? Parchetul General functioneaza!!! Ia sa vedem!</p>

Scrisoarea pare in regula. Are antetul Parchetului de pe langa ICCJ. Semnatura si stampila sunt asa cum trebuie! Dar ce spune?<br />

<p style="text-align:justify;">Memoriul meu, cu privire la starea de conflict de interese si incompatibilitate a ministrului Gheorghe Pogea, se respinge pentru ca nu indeplineste cerintele art. 222 din Codul de Procedura Penala. Ma mai uit o data. Este adresata mie, adresa de e-mail este a mea. Atunci ce naiba nu se potriveste? Pai eu m-am referit la  <em><strong>fals in declaratii</strong></em> pentru ca in declaratia de interese depusa la Secretariatul general al Guvernului si publicata pe pagina oficiala a Executivului, dl. Gh. Pogea <strong><em>a declarat ca nu face parte din conducerea vreunei societati comerciale</em></strong>, asa cum este formatul declaratiei prevazut de lege. Iar Oficiul Registrului Comertului pe un document oficial eliberat, in original la data de 11 februarie 2009, ne arata ca <strong><em>dl. Gh. Pogea este, bine merçi, administrator &#8211; director general</em></strong> al S.C. Titan Mar S.A. a familiei Adriean si Miorita Videanu.</p>
<p style="text-align:justify;">Din raspunsul Parchetului de pe langa ICCJ, inteleg ca, in cele 60 de zile, sesizarea mea nici nu a fost analizata pe fond pentru ca nu intrunea cerintele art. 222 din Codul de Procedura Penala. Ce o fi continand art. 222 ca i-au trebuit cuiva 60 de zile ca sa-si dea seama ca nu se &#8230; intruneste cerinta. Deci eu am sesizat o infractiune, am facut-o publica, posibilul infractor putea afla si sa &#8220;aranjeze&#8221; infractiunea iar eu, un nepriceput, n-am brodit-o cu art 222.</p>
<p style="text-align:justify;">Cad pe ganduri si, incet, incet intru la idei. Imi dau seama cat sunt de vulnerabil. Deja vad, cu ochii mintii, o scena de cosmar. Sunt noaptea pe strada si zaresc un om jefuit. Ba nu, ceva mai eroic. O tanara domnisoara atacata de doi derbedei. In primul rand, ma gandesc ce fac? Sa sar, curajos, la bataie aparand-o pe tanara domnisoara, asa cum m-ar impinge resortul meu de Sagetator sau sa telefonez direct la Parchetul de pe langa ICCJ deoarece, pentru mine, a ataca pe strada, noaptea, o domnisoara este de competenta acestei institutii? Hopa, ia stai un pic! Daca sar la bataie, s-ar putea spune ca fac singur dreptate, vin mascatii ma duc la beci cu Becali si Floricel iar golanii aia raman liberi si se mai si distreaza cu domnisoara. Nu, in nici un caz, as face o mare greseala. Ma uit cum golanii avanseaza in brutalizearea domnisoarei, scot telefonul si sun la Parchetul de pe langa ICCJ. Vorbesc repede, precipitat, spunand ce se petrece si cer un ajutor cat mai urgent. O voce taioasa si precisa ma opreste si ma intreaba calm:<br />
                                 &#8211; <em>in baza carui articol ne sesizati, daca aveti amabilitatea sa ne spuneti</em>?<br />
Ma simt idiot si intreb:<br />
                                  &#8211; <em>de unde dracu sa stiu, faceti ceva n-auziti cum tipa fata aia? de unde naiba sa stiu ce articol &#8230;  se petrece o infractiune</em> &#8230; ?!<br />
De la celalalt telefon se aude vocea, de aceasta data, strigand la mine:<br />
                                   &#8211; <em>pai cum, domne, n-aveti la dumneavoastra un Cod de procedura penala si va bagati in chestii d-astea &#8230; mergeti noaptea pe strada fara un Cod la dumneavoastra</em>?<br />
Deschid brusc ochii mintii, sunt transpirat si speriat. Chiar, ce mi-o trebui sa merg noaptea pe strada si sa ma mai bag si in buclucuri cu domnisoare &#8230; atat de nepregatit?

<p style="text-align:justify;">Dar stiti cum e cand te roade curiozitatea?! Ce naiba scrie in art. 222? Mai e si rotund, asa cumva ca 666 &#8230; Trebuie sa-l citesc! &#8230; Caut Codul de procedura penala. Pe internet gasesti orice iar cu Google sunt chiar prieten &#8230; Iata-l mi l-a adus nou-nout, actualizat la zi. Ia sa vedem &#8230; art. 222:</p>

<p style="text-align:justify;"> Maaaaama, ce complicat e!!! Pai daia sunt atati smecheri, hoti, pungasi liberi. Pai daca prinzi unul din asta, trebuie sa ai cel putin doi ani de drept penal ca sa-l dai pe mana justitiei. Altfel te faci de ras si mai si scapa! Daca eu inteleg bine primul alineat: &#8230; <em>trebuie sa sa fie o infractiune care m-a vatamat; m-a vatamat pe mine nu pe altcineva</em>. Adica daca el a savarsit un fals in declaratia de interese si nu m-a vatamat pe mine, nu e infractiune. Sau, daca inteleg eu bine, el, Pogea, ar fi trebuit sa tina in mana declaratia de interese &#8211; neaparat cea falsificata &#8211; facuta sul si sa ma alerge, dandu-mi in cap cu ea, cu declaratia falsificata &#8230; Siiii, abia atunci, fiind vatamat cu infractiunea lui Pogea eu &#8230; intruneam cerinta art. 222 din Cod. Domne, eu sunt de acord, o fac pentru tara! dar cum naiba il conving pe omul asta sa si-o faca sul si sa ma &#8230; vatameze cu ea (asa s-o zice?) ?! </p>
<p style="text-align:justify;">Daca tot am gasit minunea asta de Cod pe care trebuie sa-l ai tot timpul la tine &#8211; s-or gasi, oare, si editii de buzunar?! &#8211; imi arunc privirea mai jos si vad, art. 223, logic, nu? Denuntul, asa se numeste!</p>

<p style="text-align:justify;">Asta chiar imi place si suna mai potrivit pentru potlogari la nivel mai inalt. Daca ma uit bine, aici nu mai scrie ca prezumtivul infractor <em>trebuie sa ma &#8230; vatameze cu infractiunea</em> ca sa ma bage cineva in seama. Dar cei care mi-au facut raspunsul de ce n-or fi coborat privirea mai jos, pe art. 223 ca doar eu nu mi-am intitulat in nici un fel lucrarea. Am inceput-o frumos, civilizat cu &#8230; &#8220;stimata doamna procuror general&#8221; &#8230;</p>
<p style="text-align:justify;">Sa fie oare ce cred eu? Ce au facut ei n-are nici o legatura cu art. 222 si nici cu Codul de Procedura Penala. Are legatura cu &#8230; 60 de zile. L-au lasat 60 de zile la dospit sa-si acopere omul falsul in declaratii cu documente facute retroactiv, la registrul Comertului, ca doar sunt numai intre ei, clanul Videanu &#8230; Si cand au fost gata hartiile, au dat drumul la raspuns!<br />
Dar, aici, este o problema de care n-au tinut seama. Toate documentele astea contrafacute, ca sa fie valabile, trebuie publicate in Monitorul Oficial. Noi am fost cu ochii pe ei si, cum au aparut, cum le-am luat. Se vede de la o posta ca sunt trucate! Parchetul general putea face singur treaba asta, nu pe banii mei. Asa ca mai facem o sesizare la Parchetul de pe langa ICCJ, completam cu toate documentele pe care le avem, ii dam un exemplar si Ministrului de Interne si, daca nici asa nu se rezolva problema, asteptam viitorul Procuror general pentru ca, oricum, nu mai dureaza mult!

<p style="text-align:justify;">doresc sa va aduc la cunostinta fapte care, in opinia mea, intra sub incidenta legii penale, fiind de competenta Parchetului General de pe langa Inalta Curte de Casatie si Justitie.</p>
<p style="text-align:justify;">Uitandu-ma pe pagina oficiala a Guvernului, la declaratiile de interese ale ministrilor mi-a atras atentia declaratia domnului ministru Gheorghe Pogea. Am verificat apoi acelasi lucru si pe paginile oficiale ale Ministerului de Finante si ANAF constatand acelasi lucru. La data de 4 ianuarie 2009, sub semnatura sa, dl. Pogea declara ca nu face parte din nici o structura de conducere sau administratie a unei societati comerciale. In acelasi timp, dintr-un Informativ oficial eliberat de Registrul Comertului la data de 11 februarie 2009 cu nr. de inregistrare 55388 rezulta ca dl. Gheorghe Pogea este membr al Consiliului de administratie al S.C. Titan Mar S.A. avand calitatea de administrator si director general, lucru care contravine cu Declaratia de interese depusa la Guvern odata cu investirea domniei sale in functia de ministru. Am verificat si la data la care s-a depus Declaratia de interese nu era depusa nici o cerere de renuntare la calitatea de administrator si director general al S.C. Titan Mar S.A. In opinia mea, dl. Gheorghe Pogea nu avea dreptul sa omita aceasta calitate din Declaratia de interese chiar daca ar fi depus, eventual. o cerere la Oficiul Registrului Comertului atat timp cat nu avea confirmata modificarea si publicitatea prevazuta de Legea nr. 31/1991.</p>
<p style="text-align:justify;">Ca urmare, va rog, Doamna Procuror General, sa aveti amabilitatea de a dispune inceperea cercetarii asupra posibilei savarsiri a infractiuni de fals in declaratii, uz de fals, a masurii in care o eventuala infractiune a fost savarsita cu complicitatea unor functionari publici precum si a masurii in care pozitia dlui. Gheorghe Pogea, aflat evident intr-un conflict de interese, intra sub incidenta legii penale.</p>
